LetterCircuit Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Customer") and H4CF2, LLC ("LetterCircuit," "we," "us," or "our"). They govern your use of the LetterCircuit website, application, and services (together, the "Service"), which write and physically mail cards and letters on your behalf.
By creating an account, checking the box to accept these Terms, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old and able to form a binding contract. If you use the Service for an organization, you represent that you are authorized to bind that organization, and "you" includes that organization.
1. The Service
LetterCircuit lets you create messages, provide recipient addresses, and have physical cards or letters written and mailed for you. We are a software and fulfillment service. We are not a law firm, and nothing in the Service is legal advice.
2. Account Required
You need an account to use the Service. When you sign up, we create an account for you and one workspace for that account. Your workspace holds your contacts, messages, orders, and settings. You are responsible for the activity in your account and workspace and for keeping your login credentials secure. Tell us promptly at hello@lettercircuit.com if you believe your account has been accessed without your permission.
3. Wallet, Pricing, and Postage
The Service uses a prepaid wallet. You add funds to your wallet, and we draw on that balance to pay for the cards and letters you order.
- Pricing. Each order shows a per-piece price plus postage before you approve it. Per-piece prices, postage, and any platform or subscription fees are the amounts displayed to you in the Service at the time of your order. Prices and postage may change for future orders, but a change never affects an order you have already approved.
- Postage. Postage is a separate line charged at the rate displayed for each piece at the time of your order. Postage pays the carrier to move your mail and is not refundable once a piece is written and mailed.
- No cash-out. Wallet funds are prepayment for the Service. They are not a deposit account, a cash equivalent, or a stored-value instrument. Except where a refund is required by law, wallet funds cannot be withdrawn as cash and are usable only to pay for the Service.
- Payment processing. Payments are processed by Stripe. We do not store your full card number. You authorize us and Stripe to charge your selected payment method to add funds to your wallet.
- Taxes. Prices may not include applicable taxes. You are responsible for any taxes on your purchases other than taxes on our income.
4. Approval Is Your Authorization to Write and Mail
When you approve an order, you authorize us to write and mail the pieces in that order using the message, recipient addresses, and handwriting style you selected. Approval is the point at which you tell us to proceed.
- Hold at approval. When you approve an order, we place a hold on your wallet balance for the per-piece price and postage of that order.
- Capture at write. We capture (charge) the held amount for a piece when we write it. If we do not write a piece, we do not capture the funds for it, and we release the hold for that piece.
- What approval means. Approving an order is your instruction and permission to produce and mail it. You are responsible for confirming the message, the recipients, and the addresses before you approve.
5. Cancellation Before Production
You may cancel a piece any time before it enters production, which is the point at which we begin writing it. Once a piece has entered production, it cannot be cancelled, because it is being written or has already been written and prepared for mailing. To cancel eligible pieces, use the cancellation option in the Service or contact us at hello@lettercircuit.com promptly. We release the wallet hold for any piece you cancel before production.
6. Your Content and Recipient Data
"Your Content" means the messages, images, contact and recipient names and addresses, handwriting samples, and other materials you provide to the Service.
- You own Your Content. As between you and us, you keep all rights to Your Content and to your recipient data.
- License to run the Service. You grant LetterCircuit a non-exclusive, worldwide license to host, store, reproduce, process, transmit, and print Your Content solely to provide and operate the Service for you (for example, to compose, write, print, and mail your pieces, and to keep records of your orders). This license ends when Your Content is deleted from the Service, except for copies retained as described in our Privacy Policy or required by law.
- Your responsibility for recipient data. You represent that you have the right to give us the recipient names and addresses you upload and to have us mail those recipients, and that your use of the Service complies with applicable law.
7. Address Validation
When you provide a recipient address, we may send that address to Google and to the United States Postal Service to validate and standardize it. These providers return a corrected or confirmed address so your mail is more likely to reach the recipient. We rely on the address you provide; validation improves formatting but does not guarantee delivery. See our Privacy Policy for how this data is handled.
8. Handwriting Samples, Custom Fonts, and How Your Pieces Are Written
Your pieces are written by a pen plotter, which is a machine that holds a real pen and draws your message onto the card or letter in the handwriting style you choose. This is a physical writing process using real ink on real paper, not a printed font meant to look typed.
If you upload handwriting samples to create a custom handwriting style, the following applies:
- Right to upload. You represent that you have the right to upload the handwriting samples you provide and to have us process them.
- What we do with them. We use your uploaded handwriting samples and any custom handwriting style we generate from them only to provide the Service to your workspace, that is, to write and mail the pieces you order. This includes quality review, which may involve our staff reviewing and refining the style so your pieces come out well.
- Retention and deletion. We retain your handwriting samples and custom style for as long as the style exists in your workspace. We delete them when you delete the style or close your account, and sooner on your request.
9. Acceptable Use of Mail Content
You are responsible for the content you ask us to write and mail. You agree that you will not use the Service to send content that:
- harasses, threatens, defames, or intimidates any person;
- is unlawful, promotes unlawful activity, or violates the rights of others;
- misrepresents the identity of the sender or is designed to deceive the recipient about who is contacting them; or
- you do not have the right to send to the recipient.
You warrant that, for each piece, you have the right to mail the recipient and that the content is truthful about who is sending it. We may refuse, hold, or decline to write any piece, and may suspend or terminate accounts, for content that we reasonably believe violates these Terms or applicable law. We do not pre-screen content and are not responsible for it, but we may act on it.
10. Intellectual Property in the Service
We own the Service and everything in it other than Your Content, including our software, designs, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, modify, reverse engineer, resell, or build a competing service from the Service.
11. Mail, Delivery, and the Postal Carrier
LetterCircuit writes and mails your pieces. We are not the postal carrier. Delivery is performed by the United States Postal Service or another carrier, and delivery times, handling, and outcomes are outside our control.
- We report status through Mailed, not Delivered. The Service tells you when a piece has been written and when it has been mailed. Once a piece is mailed, it is in the hands of the postal carrier. We do not report a piece as delivered and we do not confirm delivery.
- No delivery-date guarantee. We do not guarantee that a piece will arrive by any particular date, or at all. Any timing shown in the Service is an estimate, not a promise.
- Addresses. We may use the address-validation tools described in Section 7, but we rely on the address you provide. We are not responsible for pieces that are undeliverable or misdelivered because of an inaccurate or incomplete address you supplied.
12. Refunds
We refund pieces that LetterCircuit fails to write. We do not refund a piece once it has been written, including because of a delivery delay or non-delivery by the postal carrier, an address you provided that was wrong or undeliverable, or content you asked us to write. Postage on a written and mailed piece is not refundable. This section is subject to any refund rights you have under applicable law.
13. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any piece will be delivered.
14. Limitation of Liability
To the fullest extent permitted by law, LetterCircuit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to the Service. Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the pieces giving rise to the claim, or (b) the total amounts you paid us in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless LetterCircuit and its officers, members, and employees from any claim or demand, including reasonable attorneys' fees, arising out of Your Content, your recipient data, your use of the Service, or your violation of these Terms or applicable law.
16. Suspension and Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or to protect the Service or other users. On termination, your right to use the Service ends. We handle your data after termination as described in the Privacy Policy. Any wallet balance is handled as described in Section 3 (No cash-out), subject to refunds required by law. Sections that by their nature should survive termination (including Sections 3, 6, 10, 13, 14, 15, and 18) survive.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that is not subject to another agreed process is the state and federal courts located in Alameda County, California, and you consent to their jurisdiction.
18. Changes to These Terms
We may update these Terms. If we make a material change, we will update the "Last updated" date and take reasonable steps to notify you, such as by email or an in-app notice. Changes apply going forward. If you continue to use the Service after a change takes effect, you accept the updated Terms.
